JAGLUS TERMS AND CONDITIONS

 

  1. INTRODUCTION

This website as well as any logos, signs, names and the like that is contained thereon are the property of Jaglus (Pty) Ltd with registration number: 2017/337941/07. No unauthorised use of any information contained on our website is allowed.

The usage of this site is subject to you agreeing to these terms and conditions, our privacy policy as well as our returns and refund policy.

Should you not agree with our policies, you are requested not to proceed any further, and also not to engage us in respect of our services and products. All our policies that might be contained under a different heading or link must be regarded as incorporated herein.

We do not allow any third party sellers or advertisers on our site or any of our mechanisms.

 

  1. PLACING AN ORDER WITH US

Once you have placed your items in your “basket”, and you have selected the checkout, you will be directed to two payment options, which include:

Once a valid form of payment has transpired (and the funds have cleared in our account) and subject to availability of your selected products, your order will be processed within 2 business days. Your order will also be handed over to our third party courier service provider within 3 business days.

Any order will be cancelled if payment does not reflect in our account within 72 hours of the order being placed.

If a selected product is unavailable you will be advised of same, within 2 business days of placing your order, and you will be directed to the options available to you, as contained in our returns, exchange and refund policy.

Any delay in the processing of your order, or any deviation from the abovementioned will also be communicated to you.

Once an order is placed, and you receive confirmation of the order, a valid agreement of sale has been concluded, and will be subject to the laws of the Republic of South Africa.  

 

  1. DELIVERY TO YOU

 

Once your order is processed, it will be handed off to our third party courier service, as indicated above. Once the order is handed over to the courier, they will be in contact with you in terms of their standard delivery specifications.

Your parcel should reach you within 3 business days, from it being handed to the courier service, dependent on your location.

Any delays relating to your delivery, will be communicated to you by the relevant courier service provider.

We do not accept any liability in respect of items damaged, lost or stolen whilst the items are in the care of the courier service provider. It is thus your responsibility to verify your product/s when it reaches you, and you are to immediately advise the courier service of any issues relating to the product/s delivered.

Should you have any specific delivery requirements that needs to come to the attention of the courier service provider, you are to advise us of same when your order is placed.

Deliveries that are not located near major hubs might take longer than 3 business days, subject to the courier service’s capacity.

A service charge will be charged in respect of your delivery and will be indicated to you upon placing your order. This fee might vary from order to order.

Once a tracking number is received from our courier service, same will be provided to you via email or SMS or Whatsapp.

Any follow up on the delivery of your parcel must be done directly with the courier service provider.

Any delivery costs and requirements, in respect of cross border deliveries, will be communicated to you via email. Any cross border deliveries might be subject to additional costs and taxes.

No refunds will be given on cross border deliveries under any circumstances.

  1. VARIATION IN PRODUCTS

Products might slightly vary in colour, than that which is seen on our site.

 

  1. PRICING

Jaglus reserves the right to change any pricing of products at any time, but price changes will not be effected on orders already placed.

Obvious errors relating to pricing on our site, will be corrected as soon as we are made aware of same, and we will not be bound by any such obvious errors.

 

  1. VARIATION AND ERRORS

Jaglus reserves its right to vary or amend its policies and terms, without any prior notice to you. It is thus your responsibility to read our policies and terms prior to placing an order with us. The change in policy/ies and terms, will be effective from the moment they are published.

We take all reasonable steps to ensure that product descriptions are correct, however should errors occur, we will not be liable for any loss, claim or expense relating to any purchase or deed upon such error.

 

  1. WARRANTY

Most of our products are wearables, and as such we do not provide any warranty on any of our products.

 

  1. SEVERABILITY

The terms hereof are severable and should any part hereof be found to be invalid, or unenforceable for any reason whatsoever, it will not affect the enforceability of the balance of these terms or any portion of our policies.

 

  1. BREACH OF TERMS AND CONDITIONS OR ANY POLICY

If you have breached any of our terms and policies, or you are suspected of any breach of same, without prejudice to any of our rights, we may elect to cancel all access (permanently or temporarily) to our site and other mechanisms, and take any action against you which we deem appropriate under the circumstances which may include legal action.   

 

  1. OUR LIABILITY

We shall not be liable for:

  • any loss or corruption of any data, database or software;
  • losses arising out of any event beyond our reasonable control;
  • any special, indirect or consequential loss or damage.

Jaglus is a limited liability entity and our officer and employees will not incur any personal liability of any kind.
